Michael P. Martin

Michael Martin specializes in business, entertainment and intellectual property law. He manages worldwide trademark portfolios for a variety of clients across a broad range of industries, including entertainment, apparel, automotive and beverages, among others. On behalf of his clients, Mr. Martin has devised and implemented trademark procurement programs in the United States and abroad, provided representation in litigation involving issues of trademark and copyright infringement, unfair competition, trade secret misappropriation and licensing matters.


Mr. Martin counsels his clients on complex intellectual property questions and advises on issues such as evaluating trademarks for selection, filing and procurement in the United States and abroad, maintaining, policing and enforcing trademark portfolios and licensing programs. Mr. Martin also handles all aspects of trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board. He counsels and advises clients on appropriate markings and copyright protection, securing and licensing patents, trademarks, copyrights and trade secrets. He counsels entertainment personalities and companies in establishing and maintaining their intellectual property rights and performs due diligence work on intellectual property-related aspects of business transactions. He negotiates and drafts business and entertainment agreements, assignments, licenses and other commercial agreements that safeguard his clients’ business and legal interests. He also has extensive litigation experience in the areas of copyright, trade dress infringement, unfair competition, trademark dilution, rights of privacy and publicity, and general civil litigation in both federal and state courts.


Mr. Martin is also regularly called upon to represent his clients’ business and intellectual property interests around the world. His clients include companies based in the United Kingdom and Mexico who have retained him to represent their interests in the United States, as well as representing U.S. -based companies with business operations throughout the world. Consequently, Mr. Martin has developed extensive contacts with intellectual property firms in countries such as the United Kingdom, Australia, Japan, China, Korea and Taiwan.


Additionally, Internet law is evolving as fast as the Internet itself. Since much of this emergent law is rooted in trademark and copyright law, Mr. Martin’s distinctive litigation experience and highly specialized knowledge of the IP field renders him uniquely qualified to combat against cyber squatters, advise on worldwide domain name registrations and disputes, monitor the web for infringements, negotiate linking and key word agreements, draft privacy policies and develop strategies for policing and protecting intellectual property rights throughout the internet, including arbitrating disputes pursuant to ICANN’s Uniform Dispute Resolution Policy.


Mr. Martin’s expertise enables him to identify, protect and defend his clients’ rights with regard to copyright, trademark, trade dress, patent and trade secret issues for a broad range of businesses.
